Terms of Use
Explains Move Memo's software license, usage rules, health and exercise safety, responsibility boundaries, and dispute handling.

1. Agreement and provider
These Terms are between you and Xinxiang Kewoku Software Development Co., Ltd. and govern Move Memo and related local features. By accepting the in-app prompt and using the full or basic mode, you agree to these Terms and acknowledge the Privacy Policy.
When the app is obtained through Apple's App Store, Apple's Standard EULA also applies unless a valid Custom EULA is provided. These Terms govern our product service and do not reduce mandatory rights under the applicable Apple agreement or consumer law.
2. Eligibility and minors
You must have the legal capacity required where you live. Move Memo is not directed to children under 13; any higher minimum age or guardian requirement under local law applies.
3. Service
Move Memo provides workout recording, Apple Health views and writes authorized by you, activity and body trends, widgets, Apple Watch collaboration, profile features, and sharing tools. Available functions depend on device hardware, system version, region, permissions, and app version.
All current features are free. The current version contains no advertising, advertising SDK, in-app purchase, or auto-renewable subscription. Move Memo provides no operator account, cloud workout backup, social network, or separate analytics SDK.
4. License
Subject to these Terms and Apple's Usage Rules, we grant you a limited, personal, nonexclusive, nontransferable, and revocable license to use Move Memo on Apple-branded products you own or control. You may not redistribute, sublicense, bypass security or payment controls, or reverse engineer except where applicable law or an open-source license expressly permits it.
5. Health and exercise safety
Move Memo is a consumer fitness record and information tool, not a medical device. It does not diagnose, treat, monitor a disease, provide emergency response, or replace a physician or qualified professional. Sensors, Health data, maps, positioning, and calculated metrics can be delayed, incomplete, or inaccurate.
Assess your condition and surroundings before exercise. Stop and seek appropriate help if you feel unwell or face an emergency. Do not operate the app in a way that distracts you or creates traffic, route, weather, or personal-safety risk.
6. Privacy and permissions
Information is handled under the Privacy Policy. Each sensitive Apple permission is optional and requested for its described feature. Refusal or withdrawal affects only that dependent feature. Never use the app to record another person's health or location without lawful authority.
7. Your content and sharing
You retain rights in profile information, workouts, routes, photos, and share cards you create. The system share sheet sends only the content you choose to the recipient or service you select. Before sharing, check that the card or route does not expose a home, workplace, health condition, or another person's information.
8. Acceptable use
Use Move Memo lawfully. Do not interfere with the app or Apple services, introduce malicious code, exploit vulnerabilities, infringe intellectual property or privacy, falsify transactions, use automated abuse, or use the app for unlawful surveillance, harassment, or activity.
9. Advertising and paid services
The current release has no advertising or paid service and presents no purchase flow.
10. Apple and external services
HealthKit, iCloud, MapKit, Core Location, Core Motion, WatchConnectivity, WidgetKit, and App Store services are provided by Apple and may change or be unavailable. Their terms and privacy rules also apply. We are responsible for Move Memo, not Apple; Apple has no obligation to provide maintenance or support for our app except as required by the applicable EULA.
11. Updates and availability
We may maintain, fix, improve, add, or discontinue a feature when reasonably necessary. We will not use an update to begin materially different personal-information processing without the notice or consent required by law. Back up or share any information you need before deleting the app; the operator cannot recover device-only data.
12. Intellectual property and open source
Move Memo's software, design, text, and branding are owned by us or the respective rights holders. Open-source components remain governed by their own licenses, which are available in the app. Feedback may be used to improve the product without transferring ownership of your personal content.
13. Responsibility and mandatory rights
To the maximum extent permitted by law, we are not responsible for interruptions or inaccuracies caused by device sensors, satellite signals, Apple services, networks, unsupported devices, misuse, or events outside reasonable control. Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, personal injury where exclusion is prohibited, or any nonwaivable consumer right.
14. Suspension and termination
You may stop using Move Memo at any time and delete local data or uninstall the app. We may suspend or terminate access to a feature for material breach, security risk, legal requirement, or service discontinuation, using reasonable notice where practicable. Sections that by nature should survive termination remain effective.
15. Governing law, disputes, and contact
These Terms are governed by the laws of the People's Republic of China, without overriding mandatory protections that apply where you live.
